No expiry of the statute of limitations in the VW diesel scandal in Germany

VW cannot get rid of the first diesel emissions scandal by talking about the statute of limitations. In its ruling on 29 July 2021, the Federal Supreme Court (BGH = Bundes-GerichtHof) made it clear that consumers did not already have to have been compulsorily informed after the emissions scandal became known in autumn 2015. Lawsuits from 2019 or even later could therefore be successful. In addition, the start of the model complaint against VW in 2018 prevents claims of those affected from becoming time-barred - even if the plaintiff had only registered for the model complaint in 2019 (Case No. VI ZR 1118/20).
