One of the negatives about eating GMO's is that it lowers the birth rate etc. I heard in the past few weeks, Jay Leno tell a joke about in the USA, we have the lowest birth rate etc. More and more people are coming down with cancer, about 1 out of every 2 people will get cancer now etc. There are many problems that come with GMO's.

From a trader's perspective, once the population knows what is in their food, the corporations of the brands that are recommended to boycot, will feel it in their pocket books:
Kellogg, PepsiCo, Coca-Cola, General Mills etc.

Read the article and find out about these corporations and if they are hit hard in their pocket book, there might be a nice short on the horizon.

TV commerical coming out:

Same companies that brought Agent Orange and DDT, also created GMO's.
Same story: those companies promoted those things were OK, till their false advertisements were proven wrong.

Cancer is on the rise and the birth rate is at a 16 year low in America and GMO's came on to the market in the 90's.
All lab testing of GMO's (Studies done outside of America) caused a rise in cancer and lowered the birth rate in those studies. All other countries except America have GMO's labeled!
The consumer has the right to know.

I personally saw, when I ate GMO canola oil, the basal cell carcinoma I was healing from, flared up within 30+ minutes of consuming it. Everything else on my plate was organic accept for the catchup that contained the GMO canola oil. By accident at another time, I ate some GMO corn and once again the basal cell flared up, during the healing process. I removed all GMO's from my diet and eventually healed the Basal Cell Carcinoma.

The body is fighting off cancer all the time, we don't need to be eating GMO's which adds to cancer growth in the body.

My mother died of lung cancer, my next door neighbor died of cancer, one of my friends who ate a lot of sugar: which is all GMO beets now, died of cancer. About 1 out of 2 people will get some form of cancer and it has increased since GMO's have been in the food supply.

You, Me and Everyone, should have the right to know, what is in their food!!!!

Posting an email I recevied:

An alarming new study released today shows that a variety of corn engineered by Monsanto has been linked to mammary tumors, kidney and liver damage and other serious illnesses in the first ever peer-reviewed, long-term animal study of GMO foods.

As a result of the massive breast tumors, liver and kidney damage, it was concluded that around 50% of the males and 70% of the female test subjects died prematurely, compared with only 30% and 20% in the control group. By two years of age, at the end of their lives, the scientists also found that 50 to 80% of female rats had tumors, compared to only 30% of those eating non-GM food.

Unfortunately, Monsanto and other GMO and agrichemical companies will do their best to prevent the public’s Right to Know about these potentially dangerous products in the food supply. In fact, Monsanto has just dumped another $2.9 million, for a total of $7.1 million, into the fight to prevent you from having the basic Right to Know what’s in your food.

Can you chip in $15 or more today to help us pass the nation’s first mandatory GMO labeling law so consumers can have the right to know if they are eating genetically engineered foods?

This alarming new study raises many questions, and one of the central questions is: Why is this the first long-term health study of GMO food that has been on the American market for over 15 years?

What this study proves is that more research on GMOs is urgently needed. It also makes it clear that until those studies are conducted, consumers like you should at the very least have the right to know which foods contain GMOs and which ones don't - so you can make healthy choices.

Hi all,

No volunteer meeting this Saturday. Instead – I’d like to ask all of you to please do one thing to spread the word on this initiative. We have less than SEVEN WEEKS until election day – and even less for mail in ballots. You are all on this list because you said this is important to you. Now is the time to get involved!

Will you:

- Place a Yes on 37 yard sign in your yard or window, and ask a friend to do the same? (I can provide yard signs!)

- Put a Yes on 37 bumper sticker on your car, and ask a friend to do the same (I can provide stickers!)

- Put flyers out in your office, store, restaurant, lunch room, club meeting, etc. (I can provide flyers!)

- Write a letter to the editor anytime you see an article on GMO’s – especially this breaking news story below. Ask the papers to endorse it in light of this study. Or if they already have, praise them for doing so – or if they have opposed it, ask them to reconsider in light of this study. (The study is a BIG DEAL – you’ll want to read it!)

- Watch the movie “Genetic Roulette – The Gamble of our Lives” or attend the Seeds of Doubt conference with a friend or three (see details below)

- Table or simply hand out a dozen flyers at an upcoming LB event (concerts in the park, expos, farmer’s markets, races, beach clean-ups – anything where people gather!)

- Spend 10 min. reading the Yes on Prop 37 website – watch our ad, see all the groups, etc. that have endorsed this, read a press release or two – and then share that info. with friends and family

- Forward this email to friends

- Got other suggestions? I’m all ears!



A lot of states are watching and waiting to see how this goes in CA. If it passes – they’ll work on a Right to Know initiative in their state as well. And a lot of countries are waiting to see how this goes as well, because the US is one of the last first world countries that doesn’t mandate the labeling of GMOs (Russia does. China does. The EU does. 50+ countries do.). The world is watching – and we are down to the wire. Monsanto alone has kicked in over $7 MILLION to fight this initiative. We need your help.

NOW we can understand why Monsanto and partners are so desperately fighting California’s Prop 37. This list is truly sickening.

GM labeling on all food products is mandatory in Europe, but here in America consumer’s are left in the dark as to exactly what they are eating.

Here is the list of Genetically Modified Foods – get ready to clean out your pantry!Prepare to blow chunks, this list is shocking. A few general observations: The availability of Non GM food vs. GM food is about 50/50. Most “brand name,” products and corporate giants genetically modify their foods. Most foods listed under the “non-genetically modified,” section are not well known and are not considered “mainstream.”

It is so unbelievably sad what is happening here. Would people here be ok with genetically modified humans, of course not. And what is the difference in the case of tampering and playing god with nature, our land, we are one with the earth, this is just so stupid and so insane. Why do people act like sheep. Until big brother tells them otherwise they just fall in line and accept whatever the system wants for them. I will only eat food from Europe now, I'm just so saddened by this tragedy, this unthinkable assault. Monsanto's seed is mixing in the wild and destroying millions of years of perfect evolution just so Romney and his cronies can make a buck. They will, and I surely hope, they all burn in hell for this horrific and disgusting display of corporate greed.

Like all, I am against GMO's and think the Prop 37 is a good idea. I don't live in CA, so I am not as close to the subject, but frankly, after I clicked on the 'No on Prop37' link, and on many of the links that support Prop 37, I was more convinced by the No vote, because the info provided is straight forward and informative.

Why all the scare tactics with the supporting vote? I learned more by reading the No ad, for instance I didn't realize that there was a distinction between grocery store labeling and non-grocery store labeling. And, why on earth is meat exempt? Who wrote Prop 37? Why don't they add more info on what is actually included and not included in the proposal, rather then all the scare tactics?

This event on October 6, from 9 am -1 pm Pacific time (LAX Hilton) will feature Dr. G.E. Seralini, lead author of the famous French rat study that was just released. See the amazing video here! Up to 80% of the female rats got massive tumors of the mammary glands, the death rate was 200-300% compared to the controls, and there was extensive damage to organs.


Dr. Michael Antoniou will be there from London. He co-authored the amazing compilation of research GMO Myths and Truths, as well as numerous other publications. He’s a world class genetic engineer working on human gene therapy techniques, but has spoken out against the use of this technology for use in food. He’s brilliant.

The leaders of the GMO labeling movements in fifteen states have joined forces to form a Coalition of States for GMO Labeling. The goals of this coalition are to pass mandatory GMO labeling laws in every state, either through legislative action or ballot initiatives, which will eventually lead to a national GMO labeling law. We also want to ensure that each state is using unified, strong language that will survive a legal attack.

Right now, all eyes are on California. The entire country is standing behind California and their efforts to lead the way with Prop 37 to pass a mandatory GMO Labeling Law. We are representing the 90% of Americans who want GMO labeling, so they have a right to know what’s in their food, a right to know what they are feeding their families. In our efforts to support one another, the following states have joined together to form the Coalition of States For Mandatory GMO Labeling: Arizona, California, Connecticut, Florida, Hawaii, Idaho, Massachusetts, Minnesota, New Jersey, North Carolina, Oregon, Pennsylvania, Vermont, Virginia, and Washington.

This comes after a French study found GMOs to have negative effects on rats, which lead to a provisional Russian suspension on imported Monsanto genetically modified corn.

Unfortunately, reports from Bay area viewers have confirmed that during the first Presidential debate the opposition ran an ad featuring a pro-biotech "scientist" from Stanford University to misrepresent the facts about Prop 37. The Stanford "scientist" in question is no everyday scientist, but biotech ideologue Henry I. Miller of the radical right-wing Hoover Institute. In what seems to be no coincidence, Henry I. Miller also happens to be the founding director of the FDA's Office of Biotechnology, which he ran from 1989 to 1994.

For the past 20 years Americans have been kept in the dark because of a politically engineered loophole that former Monsanto lobbyist Michael Taylor - now back at the FDA as Food Safety Czar - and biotech "scientist" Henry I. Miller helped implement despite the continued objections of other FDA scientists.

Even worse, Miller is literally a “founding member” the scientific club to distort and manipulate science for corporate gain over human health, including his involvement in a Philip Morris backed front group that worked to discredit links between tobacco and cancer. Miller’s love of big tobacco went so far, he wrote key PR memos recommending how Phillip Morris could stop tobacco regulations worldwide. Tragically, this same morally bankrupt “scientist” was once in charge vouching for food safety at the FDA!
Now, once again, Monsanto is using Miller and his affiliation with Stanford University as a front man for their lies to California voters. This is an outrage!

It's the final stretch on the campaign trail toward passage of California's Prop 37, the California Right to Know Genetically Engineered Food Act - and things just keep getting more interesting....

The latest news: Monsanto knows that the public doesn't trust them when it comes to public health, the environment, and supporting family farmers. That's why you won't hear too many public comments coming directly from Monsanto in opposition to Prop 37. But their $7 million contribution to the No on 37 campaign has resulted in several messengers shilling on their behalf.

UC Davis Professor Kent Bradford has become one of Monsanto's most prolific messengers in opposition to Prop 37. He writes newspaper editorials, testifies before legislative committees, and is always ready with a quote for the media. Bradford also is the director of the UC-Davis Seed Biotechnology Center. Who sits on the Center's Advisory Council? Monsanto, of course.

Monsanto's relationship with Bradford and UC-Davis doesn't stop there, as Michele Simon writes.

So, it's not surprising to find that Bradford's talking points in opposition to Prop 37 sound like they were written by Monsanto hacks themselves.

We have taken the above steps to ensure that you, the customer, can feel confident in the food we serve." According to Tony Coombes, the company's spokesperson, "Yes, this is the case, and it is because we believe in choice."

Have you seen any of our opponent's TV ads? Brutal.
The No on 37 campaign is blanketing the airwaves with lies and distortions. These ads are designed to confuse voters and steer them away from the irresistible, powerful notion that we have the right to know what’s in our food.

On Friday, the Los Angeles Times reported that the No campaign was forced to pull one of their ads off the air after they misrepresented Stanford University.

Still, a befuddled Miller appears on TV stations across the state every hour of every day – claiming Prop 37 is confusing. But Miller is confused about a lot of things – he also says cigarettes are not harmful and, in the wake of the nuclear disaster in Japan, claimed that low levels of nuclear radiation may be beneficial to our health. Yes, that Henry Miller.

On Saturday, the San Francisco Chronicle exposed misleading statements in the No on 37 ads.

They note, for example, that our opponent's claim that Prop 37 will lead to higher food costs "is based on the opposition's own study; there is no independent data that corroborate that estimate." Whoops!

Saw this video years ago, which shows you how far Monsanto will go, to keep you from knowing about one of their products that were harmful:


Monsanto is a chemical business: in their past, they would buy a company like PVC pipes and produce them and sell them and they said they had no harmful side affects till proven wrong. The factory that created their pipes had people coming down with skin and liver cancers because they were dumping their waste products in their local water etc. Eventually their product was proven to cause cancers and they closed the company down: did bankrupcy and after a certain amount of time, they no longer had to pay any money to those they harmed and never took care of the poor people who got sick and died living around their factory.
They then would find another business to buy, slap their Monsanto name on the company and go about doing the same stuff, creating harmful products till they are stopped. They have done this over and over and over again.

Wow, Victory Trader!!!

My Mom died of Lung Cancer, she smoked and her diet was oh so bad: ate the typical American Diet; Fast Food Burgers, ice cream etc. Her diet had GMO beef, all sugar is GMO's so her ice cream, drank Bovine Growth Hormone in her milk etc. She got cancer from smoking low nicotine cigarettes but I am sure, all the GMO's in her diet contributed to her downfall. Her lung cancer spread to her spine. She had a big bump by her spine (the cancer). It eventually spread to her brain. Seeing GMO's cause tumor growth, I am sure it shortened her life. On her side of the family, they live to be in their late 90's. She died at 76. I remember visiting an anut on her side of the family, in her 70's she ran up a flight of stairs, taking 3 steps at a time. My mom would have lived to a ripe old age, if she had taken care of herself.

My next door neighbor died of prostrate cancer, my cousin got breast cancer (ate GMO's), one of my dear friends died of cancer and she LOVED to eat regular sugar: which is GMO beets, I have a friend that can't get pregnant (she eats organic but sometimes eats regular sugar and her husband eats the regular American diet full of GMO's).
I got a basal cell carcinoma and cured it. I used to eat a lot of soy products and at the time, I didn't know all soy was GMO's etc. I cured the basal cell carcinoma and one of the things I did was cut out ALL GMO's in my diet. When I eat soy products: they are ALL organic, I make sure of that. I have had NO re-occurance of any basal cells, which is unusal because they usually return. I make sure I eat a GMO free diet and also eat certain foods that kill off cancer etc.

One of the things my Mom did was teach statistics and she told me, you can manipulate any research according to how you do the stats. When we were in with her chemo doctor, he was quoting some stats on some study and my Mom called him on it. Afterwards, her own CHEMO DOCTOR said with a smile on his face, yes, it is easy to get the study to turn out how you want it.

I think, those people who have no consciousness about how they have brought GMO's to market and are harming people, have an old way of thinking about things. Their attitude is arrogant and self serving with NO ethetics. They stopped teaching ethetics in University's etc. A lot of these supposed scholars who come out and make endorsements on things, are all bought and sold to the Corporations. It is a "Me" Mentality with NO consciousness of "We" and seeing yourself in humanity. That we are all one and in the same. In this respect, animals have more understanding and compassion than these types of people.

Science or scientists, need to have the ability to consider how what they do will effect humanity. Just because one can do something, doesn't mean we should go ahead and do it.
The American Indians were more advanced in their thinking: they would always consider how their actions would affect 7 generations in the future.

It's easy to get caught up in refuting our opponent's misinformation campaign and exposing their discredited spokespeople. And, indeed, since an avalanche of radio and TV ads can turn a simple issue into one that is complex, it's important that we push back.
Help us push back against the pesticide and junk food companies funding the opposition by chipping in today.

The best way to push back, of course, is with the truth. To that end, best-selling author and journalist Michael Pollan penned an excellent piece for New York Times magazine worth sharing widely.

"The [food] industry is happy to boast about genetically engineered crops in the elite precincts of the op-ed and business pages — as a technology needed to feed the world, combat climate change, solve Africa’s problems, etc. — but still would rather not mention it to the consumers who actually eat the stuff," Pollan writes.

"Presumably that silence owes to the fact that, to date, genetically modified foods don’t offer the eater any benefits whatsoever — only a potential, as yet undetermined risk. So how irrational would it be, really, to avoid them? Surely this explains why Monsanto and its allies have fought the labeling of genetically modified food so vigorously since 1992."

This is how Europe got their GMO's labeled, Kellogg's won't make Corn Flakes just for California, to name an example. If we get Prop 37 passed, Kellogg's will just start making all their products with non GMO foods. Some have already switched in the dairy industry, if we get this passed, it will cause the tide to turn.

Food Babe to President Obama: Label GMOs!

Did you see what Vani Hari of FoodBabe.com did at the Democratic National Convention?

She grabbed a place near the stage in front of the TV cameras, and when Obama's USDA Secretary Tom Vilsack spoke at the convention, she held up a sign saying "LABEL GMOs". Vilsack – the former Biotech Governor of the Year – is responsible for the decision that allowed Monsanto to push its GMO alfalfa, sugar beets and sweet corn into the market – without labels. Vani Hari's action was captured live on TV and made national news. Afterward, she made an inspiring video about the experience.

Under capitalism, the aim of companies is to make money, to maximise profit for shareholders. According to Professor Colin Campbell of Cornell University, any safety requirements are secondary concerns, if they are concerns at all. Therefore, in a democratic society, we expect the state to take care of these concerns on our behalf. But how can it when the US government, especially over the past two decades, has become a subsidiary of agribusiness corporations by acting on their behalf? In the US, via its control of the FDA and other federal regulatory agencies, agribusiness is effectively in charge, telling the public that their GMOs are safe.

But who in the world can believe this from certain players with a track records of deceit and criminality? Who can believe this when the revolving door between government bodies and top corporate officials leads to policy being formed on behalf of corporate self interest?

Yesterday, the Yes on 37 campaign sent letters to the U.S. Department of Justice requesting a criminal investigation of the No on 37 campaign for possible fraudulent misuse of the official seal of the U.S. Food and Drug Administration (FDA).

The No on 37 campaign affixed the FDA's seal to one of the campaign's mailers. Section 506 of the U.S. Criminal Code states: "Whoever...knowingly uses, affixes, or impresses any such fraudulently made, forged, counterfeited, mutilated, or altered seal or facsimile thereof to or upon any certificate, instrument, commission, document, or paper of any description...shall be fined under this title, or imprisoned not more than 5 years, or both."

When I lived in Evanston, IL a few years ago they swooped in and bought up all the independent Natural Food stores creating a monopoly on the market. I detest them and refuse to shop there.

This week the House of Representatives will consider a provision to House Agricultural Appropriations Bill that will fundamentally undermine the concept of judicial review. Hidden under the guise of a “Farmer Assurance Provision” (Section 733), the provision strips the rights of federal courts to halt the sale and planting of genetically engineered crops during the legal appeals process. (We really need to change our government so corporations can't use the system to their benefit: loopholes. Government and corporations should be separate just as church and state are!)

PS I have stopped buying from Wholefoods also, I buy from Mother's health food store. They are small, non-corporate and have better prices. Sprouts is adding more GMO foods also, so that is good. I have a box of organic veggies delivered each week from Farm Fresh To You , so I support buying directly from our organic farmers.

Today I received in the mail a flyer stating: VOTE NO on Prop 37 and it is endorsed by: Californians Vote Green.

Now, the Green Party endorses voting YES on Prop 37!!!!
Green Party Enthusiastically Supports Prop 37: Label GMOs!

I have sent this info to Jeffrey Smith and the Green Party hoping they can add this to deceptive ads etc. Monsanto is doing. This flyer gives http://californiansvotegreen.com/ as their website.

Another deceptive ad stating a San Francisco Newspaper said vote NO on Prop 37 and quickly afterwards took down that website because it was a lie etc.

The toxic hand of GMOs does not stop in our food supply. GMOs are used in various prescription medications and vaccines, and GMOs in vitamins and supplements is also common. There are numerous examples.

YIKES! A scary thought for all those who use supplements. I dont myself... I do a lot of juicing etc.

I know that I would ask suppliers at the health food stores where people buy their supplements - about this, to make sure this is not happening with the supplements people are taking. You cannot take it for granted that supplements all of us buy may have GMO components.

An informed consumer is a healthy consumer, in this case!

I just want to add a footnote, many a time, I emailed Senator Boxer saying we need to get rid of GMO's etc and in her emails, her stance was agaisnt my view point. She stood with GMO's etc. Needless to say, I was very dissapointed etc. It is very interesting with the growing movement of concerned citizen's 3 days before we go to vote, she now joins with public opinion our right to know. Even more interesting, she says she brought a bill to label years ago. From my past communications with her, with her pro GMO point of view, I would LOVE to see that bill!!! I don't trust a word she says because of what her past pro GMO stance in past communications with me.

If we are getting our Senator's to stand with public opinion there is hope! It shows how strong this movement is getting.

#12 Lies about GMOs' Safety - TRICK: GMO's are "perfectly safe." TRUTH: No one's
vouching for the safety of genetically engineered foods. This summer, the
American Medical Association passed a new resolution calling for mandatory
pre-market safety testing of GMOs. The GMO foods that are currently being
consumed in the US not only aren't labeled, they have never been safety tested
by independent parties.

#13 Lies about the National Academy of Science - TRICK: The National Academy of
Sciences says GMOs are safe and there's no reason to label them. TRUTH: The NAS
study referenced by the Monsanto-Pepsi gang is the 1987 report, Introduction of
Recombinant DNA-Engineered Organisms into the Environment. The 1987 NAS report
doesn't address the issue of GMO labels and doesn't claim to present evidence
that GMOs are safe for human consumption. GMO foods didn't exist in 1987, so
they couldn't have been safety tested then. The NAS only argued that GMOs
shouldn't be treated differently from normal organisms. The fact that government
regulators followed the NAS approach and failed to treat GMO foods with any more
precaution than normal foods is not evidence that they are safe or shouldn't be
labeled.

organic industry and it looks like they've exempted themselves from the law. Why
would organic be exempt, while producers of conventional food have to label

without the use of genetic engineering. The organic law is actually much
stricter than Prop 37 because it requires third-party certification.

food costs for needy families. An average family's annual grocery bill would
increase by $400. TRUTH: 61 other countries label genetically engineered food
and there isn't a single real-world example of increased food costs. Likewise,
food prices didn't go up in the US when information about allergens - or any
other piece of information - was added to labels. What makes the Monsanto-Pepsi
gang's grocery bill trick so dirty is that the $400 figure they cite is actually
their estimate of the cost of companies switching from GMO to organic to avoid
labels, not the cost of GMO labels themselves.

#26 Lies about Costs to Farmers and Processors - TRICK: UC Davis Professors of
agricultural economics released a report that showed Proposition 37 would
increase costs for California farmers and food processors by $1.2 billion.
TRUTH: The No campaign paid the authors of this study, Julian Alston and Daniel
Sumner, at least $30,000. The study assumes that farmers and food producers will
respond to Proposition 37 by switching from genetically engineering to organic
to avoid the labeling. The authors don't devote much attention to the
possibility that producers will respond to the labeling mandate by simply
relabeling.

#27 Lies about Costs to Taxpayers - TRICK: Prop. 37 "would cost California
taxpayers millions for more bureaucracy and red tape." TRUTH: This nonpartisan
Legislative Analyst's Office's estimates the annual cost of enforcement as "a
few hundred thousand dollars to $1 million."

#28 Lies about "Natural" Claims - TRICK: Based on an analysis by Peggy Lemaux,
part of the Monsanto-Pepsi gang, NPR's Eliza Barclay wrote an article claiming
Prop 37 would stop producers of any processed food from using the term
"natural." TRUTH: Only processed food containing GMOs will be blocked from
carrying "natural" claims under Prop 37. The Center for Environmental Health
pointed this out to Barclay and she corrected her report.

#29 Lies about Prop 65 - TRICK: Prop 37 is just like Prop 65. TRUTH: Proposition
65 granted private attorneys a share of fines and penalties exacted from
violators, making it more of a bounty system. Proposition 37 doesn't do that.
Private attorneys can sue only to obtain injunctions, not penalties.

#30 Lies about Damages - TRICK: The independent, nonpartisan Legislative Analyst
says that Proposition 37 would allow trial lawyers "to sue without needing to
demonstrate that any specific damage occurred as a result of the alleged
violation." TRUTH: Say you buy a box of cereal whose main ingredient is corn.
It's not labeled GMO, but you get it tested and find that it has levels of GMO
above what could result from unintentional contamination. You bring a lawsuit
under Prop 37. You might be right that the processor intentionally used
genetically engineered ingredients without labeling them, but what's your
"damage"? If you suffered no harm, there aren't any damages that can be
recognized under the law, except maybe what you paid for the cereal. If Prop 37
required a demonstration of damages before a violation of the law could be
rectified, GMO labels couldn't be enforced. The advantage to this system is that
the only incentive to sue will be to enforce the law, not to win money
damages.

#31 Lies about Trial Lawyers - TRICK: Prop 37 was written by trial lawyers for
trial lawyers. TRUTH: The California Right to Know campaign began with the
efforts of Pamm Larry, a former midwife, farmer and longtime Chico resident. In
2011, Pamm started organizing mothers and volunteers across the state toward a
2012 ballot drive with only one goal in mind: to let California consumers know
if the food they are eating is genetically engineered. With the help of

and retailers because they have to obtain and keep "reams of paperwork." TRUTH:
Retailers would only have to label the few raw commodities (sweet corn, papaya,

farmers, as opposed to a packer who would have responsibility for labeling. They
can either stick a simple label on the bin or, if they wish, they can ask their
farmer supplier for a sworn statement that the crop is not genetically

If they're selling direct to customers, farmers need to label their genetically
engineered produce. If they're selling into the supply chain, all farmers have

genetically engineered (if the crops are typically GMO). Genetically engineered
seeds are patented, they can only be used under contract and must be purchased
each year, so farmers definitely know whether they're growing GMOs. Monsanto's
the only one suing farmers.

When I started learning about GMO's it was very disturbing, how could these people introduce this into our lives and genetic pool? How could other's harm us with no regard?

Then as I have been a member of futures.io (formerly BMT), watching and learning in the Unexplained thread, I learned more and more. My eyes were opened more besides my own observations of what was going on with our society from the fact that I am a trader. Most traders are agaisnt the devaluing of the US dollar etc.

When I look at all the things going on the world:
1. Our elected officials are in the pocket of corporations
2. The Federal Reserve: who are not elected officials, get to decide the fate of our dollar
3. Our Presidents don't keep their campaign promises
It goes on, how I would love to have the Federal Gov. smaller and out of my business etc. but I am just a small individual etc.

What I see happening with Prop 37, people coming together to make a positive change, is very inspiring and gives me hope. Even if we do not win in this election, people are becoming informed and will vote with their purchasing dollar and that will eventually make the change we need.

Also, it came to me, how to deal with all these powerful forces in the world: I am not buying into their belief system, I am going to sing's John Lemon's song: Love, Love, Love, da da da da, All you need is Love, Love, Love, Love etc.

Even if this brings a smile to your face, that is great.

I am going to hold thoughts of Love for all living creation and whatever the future brings, my response will be one of love and compassion. I may not be able to have a big impact in the world or course of events but I can make a difference in my life and hold a positive frame of mind, no matter what the outcome is on this coming election.

It might be a simple idea but I think it is a lovely one.

Thanks for all the work you do on this thread and alerting about GMO's Rachel. Just like big oil, big pharma, big media, it's all about the dollar and corporatism imo. On one hand as we are all trying to make money off the markets as traders or investors here, I believe in the freedom of the investor and the markets, on the other hand disregarding the public good and ramming through national and state policies trying to bypass or fool the voting public, in the name of commanding shareholders and insider trading is just going too far.

Thanks for the thread and information which helps inform my vote on proposition 37 as a fellow Californian. I am voting no on prop 30. Unfortunately, the public sector in California which I do realize are many families , even neighbors , has to realize state worker wages and pentions can not be maintained and increased at the expense of the state taxpayer, while the rest of the private sector's wages have stagnated and continue to fall below the rate of inflation. Until or if, the state and country figures out how to solve all this collapsing job(real full time jobs) market, wage deflation and offshored job mess. And there are too many useless "required breadth" classes taught in high school and state colleges that do not prepare anyone for the real job market. Despite the union ads for prop 30, research by taxpayer associations have found out prop 30 does NOT guarantee the raised taxes proposed will go straight "to... the.. children!"; in fact the funds are meant to support salaries and pensions.

California has enough food and crops to feed the entire world. Yet somehow food prices keep rising and the food never reach the hungry populations in the third world nations.

MASS DEMONSTRATION PLANNED AGAINST SEMINIS, OXNARD

Besides the big banks and franchises, i.e. BoA, Costco, Home Depot, Walmart, most of the rest of "industrial" buildings around are "for sale/for lease" signs.

I have been waiting to receive any emails regarding inaccurate polling stuff but haven't heard anything yet. It is dissapointing the bill didn't get passed this time. The good thing is, more people got informed about GMO's and will use their purchasing power to avoid them in the future and that will eventually lead to the tipping point.

It is certainly a battle of David and Goliath but we know, who one eventually. Today was one step back after many steps forward and there are other states that will bring their right to know to their citizens.

I also did a little research from all the video's posted and forgot the website but 3 years ago they did testing of organic corn, to see if it had any GMO's in it? There were a few kernals of the organic corn that had GMO's in it. So, I have decided not to eat any organic corn or soy beans because I think it is on it's way of Canadian Soy which is now all GMO.

So, my fellow human beings, be the change in the world you want to see.

Yesterday, we showed that there is a food movement in the United States, and it is strong, vibrant and too powerful to stop. We always knew we were the underdogs, and the underdogs nearly took the day. Dirty money and dirty tactics may have won this skirmish, but they will not win the war.
Today, we are more than 4 million votes closer to knowing what’s in our food than when we started. This is a victory and a giant step forward. We are proud of our broad coalition of moms and dads, farmers, nurses, environmentalists, faith and labor leaders who did so much with so few resources to bring us to this point, and we will carry forward.

These results are also a reminder of the corrupting influence of huge multinational corporations on our electoral process. The world’s leading pesticide and junk food companies outspent Yes on 37 by more than 5 to 1, and beginning on October 1, spent about a million dollars a day on a hailstorm of false claims, misrepresentations and fear mongering over five simple words on a label. In the end, they spent enough money to hide the truth from the majority of voters. But the food manufacturers are on the wrong side of history; they should not fight their customers, but join them.

Today is not the end of our campaign to secure our fundamental right to know what’s in our food. It is a strong beginning, and we thank the millions of Californians who stood with us. We are proud of our grassroots movement, our 10,000 hardworking volunteers, and the diverse coalition of health, faith, labor and consumer groups that stood with us. Many people assume that the Food and Drug Administration tests genetically engineered foods for safety.

But as USA Today reports:

Q: Does the FDA test these foods before they’re allowed on the market?

A: No. Instead there is a voluntary consultation process. Genetically engineered foods are overseen by the FDA, but there is no approval process. Foods are presumed to be safe unless the FDA has evidence to the contrary, Jaffe says. The FDA “has to show that there may be a problem with the food, as opposed to the company needing to prove it’s safe to FDA’s satisfaction before it can get on the market,” he says.

First of all, let’s celebrate with San Juan County, Washington, for passing its GMO-Free County initiative. Growing GMOs in the San Juan Islands will shortly be illegal. Thanks to all the great volunteers (and the 60% of the voters) who made that possible. I had the great pleasure of doing a speaking tour on three of the islands in September; their campaign was truly an inspiration. Well done San Juan County!

Prop 37

California’s Prop 37 campaign was the latest (and greatest) expression of the rising anti-GMO tide in the US that has swelled over the last 2-3 years. Other expressions have included the popularity of the Non-GMO label in grocery stores, the huge number of activists working on GMO issues, the unprecedented GMO coverage in the media, and the 19 state legislatures that considered GMO labeling bills. These are all early signs of a coming tipping point of consumer rejection. What sets Prop 37 apart, however, was how profoundly it has accelerated anti-GMO sentiment in both quantity and quality.

Huge numbers of people became aware for the first time that they were eating GMOs—we have changed the whole conversation. And numerous actors, chefs, musicians, artists, filmmakers, politicians, comedians, and others chimed in support of our side for the very first time. Being against GMOs or pro-labeling has clearly become cool.

From the quality perspective, I was blown away by the enthusiasm, competence, and utter devotion of the California volunteers. What I witnessed in the more than 50 events I attended throughout the state over the last 90 days was totally unique in my experience. The depth and solidarity of commitment to this issue is profoundly established.

Although we narrowly lost on the vote, the campaign has propelled our movement forward onto a whole new platform. I am more confident and optimistic than ever that we will soon achieve the tipping point that we all desire.

GMO labeling efforts change course after California defeat

(Reuters) - The failure on Tuesday of a California ballot initiative that would have mandated labeling of genetically modified foods is not a death knell for those seeking nationwide labeling, U.S. labeling proponents said.

President Barack Obama's re-election could be a boost, as he is seen, in general terms, as being supportive of labeling. Still, efforts to force change at a federal level could face an uphill climb.

"The federal effort is a monumental task without a state victory somewhere," said Michele Simon, a public health attorney from California.

New state labeling initiatives are planned for Washington state and Oregon. Beyond that, the action now shifts to Washington, D.C. and efforts to force change at the U.S. Food and Drug Administration, which has primary regulatory oversight for food and food additives.

A citizen's petition is pending with the agency demanding a re-examination of its policy against labeling of foods that contain genetically modified ingredients. More than one million people signed on, the most ever for a petition to the FDA, and backers say the effort has been aided by the publicity surrounding the California initiative.

"When we first filed our petition with the FDA over a year ago ... it was only a handful of Washington insiders who fully understood what we were talking about," said Gary Hirshberg, co-founder of Stonyfield Farm organic yogurt company, and chairman of the "Just Label It" campaign. "Now average folks are well educated on this issue."

Supporters of the federal labeling action include organic and natural food companies, environmental and consumer groups.

The petition, filed in October 2011, is the first step in a strategy that could lead to a federal lawsuit against the FDA, said Andrew Kimbrell, the lead attorney with the Center for Food Safety, who wrote the legal petition.

Kimbrell said passage of the California measure would have provided leverage for the federal effort. Its 53 percent to 47 percent defeat in progressive California was a setback, but the legal strategy with the FDA does not depend on state passage.

Rather, CFS hopes to prove that the Federal Food, Drug, and Cosmetic Act, dating back to 1938, is being too narrowly interpreted by FDA and treats modern-day GMO technology in a way that does not comply with the intent of the law to protect consumers.

Genetically modified crops, which have had their DNA spliced with genetic material from other species, have been around for 16 years. Popular biotech crops can survive treatments of weedkiller and are toxic to insects that feed on the crops. And most processed foods sold in the United States contain some GMO corn, soybeans or other crops.

The CFS petition calls on the FDA to declare that molecular or genetic alterations are "material" changes relevant to consumers. The FDA's current policy, set in 1992, holds that foods derived from genetically modified plants were substantially equivalent to those produced through conventional means.

"The combination of FDA's failure to mandate pre-market safety testing and its permissive labeling policy has meant that silent changes to our food supply are tested on the public without their knowledge," the petition alleges.

FDA spokeswoman Morgan Liscinsky said the agency was evaluating the petition and will respond, but declined to comment further.

The California labeling measure failed in part after an onslaught of opposition led by Monsanto Co, the world's largest seed company and the developer of much of the world's genetically modified seed technology.

Campaign finance reports show Monsanto and almost 80 food companies and biotechnology advocates, including PepsiCo and DuPont, spent roughly $46 million to turn back the California effort. They argued that GMO food products are proven safe, and labeling would add unnecessary costs and regulation.

They make a similar argument against any federal labeling mandate, saying the FDA's view that no labeling is needed is proper.

"New biotech foods are appropriately tested for safety," said Karen Batra, spokeswoman for the Biotechnology Industry Organization, which represents the interests of the biotech seed industry. "No crops are commercialized without USDA and FDA review."

That position frustrates many in the scientific community, who say the industry and regulators are disregarding numerous studies showing harmful impacts from GMO crops.

In a letter published in October in the Independent Science News, more than 70 scientists, academic researchers and professors said that "corporate influence" was stifling research that finds negative implications connected with GMOs.

"We are going to have to come to grips with this. Every major trading partner we deal with has labeling," said Hirshberg. "Labeling of GE (genetically engineered) foods is not a question of whether, but when."

We here at Green America are disappointed by the defeat of Prop 37 -- the initiative to label GMO products in California -- but we are not deterred.

Big Agriculture massively outspent the pro-labeling forces in California, which only means we need to step up our game in spreading the word about GMOs.

In the US, more than 94 percent of the soy crop, 95 percent of the sugar-beet crop, and 88 percent of the corn crop are genetically modified. Because of the prevalence of soy, corn, and sugar in processed foods, more than 30,000 GMO food products sit on US grocery shelves unlabeled.

GMO food products have not been independently tested by the FDA, and have been linked to food allergies, irritable bowels, cancer, and birth defects. What's more, GMOs harm the environment through increased pesticide-use, the rise of super-bugs and super-weeds, and loss of biodiversity. These are serious consequences, and the public has a right to know what they're supporting and what they are eating when they purchase a product from a grocery-store shelf.

In September 2012, the research team led by Gilles-Eric Séralini at the University of Caen published the findings of their feeding trial on rats to test for toxicity of Monsanto’s genetically modified (GM) maize NK603 and/or Roundup herbicide in the online edition of Food and Chemical Toxicology [1].

Séralini and his colleagues had previously found evidence for toxicity of GM feed in data from Monsanto’s own experiments, which they had obtained through a Freedom of Information demand [2]. Monsanto challenged their conclusions and, to no one’s great surprise the European Food Standards Agency (EFSA) supported Monsanto [3]. So the team decided to run their own experiment, using an unusually large number of animals and over a period of about two years, roughly the life expectancy of the rats, rather than the usual 90 days required in toxicity trials including Monsanto’s.

What Séralini and his colleagues found was that NK603 and Roundup are not only both toxic as expected, but also carcinogenic, which was unexpected. The proportion of treated rats that died during the experiments was much greater than the controls; moreover, in almost all groups a higher proportion developed tumours, and the tumours appeared earlier.

This isn't over.

We're not just looking at how many votes in California are still uncounted. We're not just guessing how it'll turn out and making little projections. That's a sucker's game.

We're looking at real symptoms of fraud. And fraud has tentacles and arms. You see one piece of fraud, you keep digging for other pieces. You usually find them.

According to investigative journalist Jon Rappoport, more than one million votes on Prop 37 (the GMO labeling initiative) in California have gone uncounted to date. Since the margin of "victory" is about 600,000 votes, this means Prop 37 may conceivably have passed.

Rappoport called the voter registrar offices in the largest California counties and nearly 1.7 million votes remain uncounted in Santa Clara, Los Angeles, San Diego, and Orange Counties alone. It is still unknown how many votes are uncounted in other California counties.

When I read the news that Prop 37 had been defeated, I was shocked and saddened as I knew a great campaign had been run to defeat Monsanto and its flock of agri-business friends and their infinitely deep pockets that had funded the “No Campaign.” I knew that the “No Campaign” had been unscrupulous and had resorted to fraudulent tactics and misleading advertising just so Californians would not be able to have label transparency so that they would know what they were consuming. With the many grassroots organizations (including the National Health Federation) and many thousands of consumers fighting a clean, strong battle, we couldn’t match the funds but the vote call of defeat was so close.

Don’t hang up your hats quite yet, read further, this battle isn’t over!

Jon Rappoport, of No More Fake News Jon Rappoport Investigative Reporter had alerted readers to the fact the “No Campaign” had feloniously used the official FDA seal and statements during their campaign attributing the statements to the FDA, WHO, and other organizations to convince Californians to vote against Prop 37. Rappoport stated, “The NO ON 37 forces have been caught in a deception. They used the official seal of the FDA in a mailer, and above that seal they attributed a quote to the FDA which was never made by that agency. The quote was: "The US Food and Drug Administration says a labeling policy like Prop 37 would be 'inherently misleading.'"

On November 8th, I read Jon’s next article concerning Prop 37, fraud, and the final vote counting issue. I immediately contacted Jon and Barbara Peterson of Farm Wars ( Farm Wars), both strong health-freedom fighters, and they and NHF decided to fight back. Was Proposition 37 really lost? Why was the “Yes Campaign” stating defeat we wondered. The final vote count wasn’t until December 14th, there had been obvious fraud by the opposing campaign, and our collective nature is to fight until the end. NHF contacted some of the main “Vote Yes” groups questioning their calling defeat, Jon continued investigating those who actually had called the vote and other issues while Barbara sent word out to her lists and decided to get our questioning message out on an upcoming George Noory radio show. The ball was rolling and is still rolling. People and organizations are getting back up to continue the fight for Prop 37 now and the NHF asks that all readers join us by informing others.

The issues at hand now are below and this is information to get out to people that this issue isn't over until all votes are counted and the fraud issue pursued.

These results are from the California Secretary of State as of
November 8, 2012 at 4:30 a.m. PST with 100% of the state's
24,491 precincts partially reporting. The vote total will grow
substantially as each precinct counts its absentee, mail-in and

Thank you so much for signing this petition.

I have to admit I have learned a great deal since starting it.

ALL VOTES ON PROP 37 WILL BE COUNTED, not because of our petition, but because it is required by law that all votes be counted. The counties have until December 7 to report the vote and Debra Bowen, Secretary of State, has until December 14 to certify the vote.

The final results WILL BE PUBLISHED, so every vote cast on Prop 37 will be honored.

Because of the importance of this issue nationally, I am researching how to have an effective petition at a national level.

As you know, the fight to pass Prop 37 in California was unsuccessful - due to the millions spent by the No on 37 campaign to spread lies and obfuscate a very simple issue: We have a Right To Know what's in what we eat and drink, and feed to our families. The Food and Drug Administration (FDA) may soon approve genetically engineered salmon, which would be the first genetically engineered animal on supermarket shelves in the United States. And the U.S. Department of Agriculture (USDA) is considering a new type of herbicide-resistant corn that will encourage the use of more chemicals in our food supply.


Bottom line? Our leaders won't let you make informed consumer choices at the grocery store because current policy doesn't require that genetically engineered foods be labeled.

We have a right to know how the food we buy is produced. Yet the FDA's current policy does not provide us with the ability to make informed choices about genetically engineered foods because they are not labeled.

Over forty countries – including Russia and China – require the labeling of genetically engineered foods. We have the power to fix this here in the United States, and there's never been a more pressing time.

The FDA is on the brink of approving genetically engineered salmon, which would be the first genetically engineered animal on supermarket shelves in the United States. The salmon is engineered to produce growth hormones year-round that cause the fish to grow at twice the normal rate. The government already requires labels to tell us if fish is wild-caught or farm-raised – don't we also have a right to know if our salmon is genetically engineered? But without labels, we'll never know.

You stood with more than one million Americans for our right to know by contacting the FDA demanding that genetically engineered foods be labeled. But there are so many others who haven't heard anything about the reasons to label genetically engineered foods.

Last week more than 5 million California voters stood up for transparency and labels on genetically engineered foods by voting Yes on Prop 37. We came up short on election night, but have built a powerful movement that has changed the conversation on GMO labeling in the U.S. forever.

At Food Democracy Now! we want to express our gratitude for you and all of our members who helped place Prop 37 and labeling of genetically engineered foods as a central part of the national debate during this year’s election.

It was a hard fought race and we’ve been amazed and inspired by the grassroots support in California and across the country. Despite being outspent nearly 6 to 1, the Yes on 37 campaign fought Monsanto and DuPont to a standstill with 47.6% to 52.4% at the polls.

We may not have won on election night, but what we did gain is unprecedented and can never be taken from us: the fact that millions of people have stood up for democracy and labeling of genetically engineered foods, and we have fundamentally changed the conversation in the U.S. forever.

What's next?

Along with our allies, we've been encouraged to hear this question ring throughout California among those who gave their heart and soul to this fight and within the growing national food movement: "What's next?"

Food Democracy Now! has been a part of this fight from the beginning and along with our close allies who fought with us every step of the way, we can tell you that this fight is not over and we will not stop until we achieve transparency and the basic Right to Know what's in our food.

Why do 61 other countries enjoy this right while Americans do not?

It's time that we make sure these questions are heard at the highest levels here in the U.S., from the White House to Congress to state capitals across the country.

Right now efforts are unfolding in Washington state where volunteers are gathering signatures to place an initiative similar to Prop 37 on the ballot in 2013 and there are attempts to get President Obama to enact his 2007 campaign promise to label GMOs in Washington DC. No matter what, GMO labeling in the U.S. is going to become a reality.

Election Results and False Reports of Voter Fraud

Despite numerous reports of voter fraud in the election on Yes on 37, there have been no proof of fraud or vote tampering in California. As with every election, not every ballot is counted on election night and currently Food Democracy Now! is working with the California Right to Know campaign to monitor the final vote tally from the state.

As of November 16, 2012, the vote totals are 5,869,382 NO to 5,329,994 YES, with the NO side ahead 52.4% to 47.6%.

California state law requires county elections officials to report their final results to the Secretary of State by December 7. The Secretary of State has until December 14 to certify the results of the election.

Food Democracy Now! will continue to monitor these election results with our allies and report the latest results.

They're at it again. The same powerful interests that spent $44 million to mislead voters in California about Proposition 37. The same companies pushing the Food and Drug Administration to ignore the voices of 1.2 million Americans – including you.

Now with Congress back in session, these agri-chemical companies are trying sneak a proposal into a must-pass piece of legislation to boost their profits at the expense of your right to know. They want to allow GMO seeds to be planted even if a court finds they were approved illegally.

But there's a way to stop them: Rep. Peter DeFazio from Oregon is building a coalition of lawmakers to come out in opposition to this proposal – and he needs your Representative to join him. The House could vote on this soon, so we need more members on our side.

In addition, Senator Daniel Inouye, Chair of the Appropriation Committee, is the key to blocking passage in the Senate.

Big agri-chemical companies that defeated Prop 37 have had their lobbyists insert a dangerous biotech policy rider into the 2013 Agricultural Appropriations Bill. Bottom line? The proposal will reduce the oversight of genetically engineered foods.

A threat to the environment? Economic risk to farmers? This provision ignores those concerns. It's specifically intended to force the Department of Agriculture (USDA) to approve genetically engineered crops – even if we don't know the impact.

Tell Congress to Dump the Monsanto Rider

Though wrapped in a “farmer-friendly” package, this biotech rider (section 733) is simply an industry ploy to continue to plant GE crops even when a court of law has found they were approved illegally.

The provision is intended to force USDA to grant temporary permits and deregulations of GE crops even if a Federal court rules that USDA hadn’t adequately considered the environmental or economic risks to farmers. This would negate any meaningful judicial review of USDA’s decisions to allow commercialization of GE crops. If a GE crop approval was shown to violate the law and require further analysis of its harmful impacts (as several courts have concluded in recent years; GE alfalfa and GE sugar beets, for example) this provision would override any court-mandated caution and allow continued planting and commercialization while further review takes place. Further, it forces USDA to approve permits for such continued planting immediately, putting industry completely in charge by creating loophole approvals tailored to counter any “inconvenient” court decisions for the industry.
Tell Congress to Dump the Monsanto Rider

There is only a short period of time for Congress to resolve the Appropriations Bill before the end of the lame duck session. Please tell your Representative to support the DeFazio Dear Colleague letter opposing the biotech rider and urge Senate Appropriations Chairman Inouye to oppose the rider!

The “Big 6” pesticide corporations are hoping USDA will quietly green-light their suite of “next generation” GE seeds, including Dow's 2,4-D-resistant corn and Monsanto's dicamba-resistant soy.

If approved, these herbicide-resistant crops in the pipeline — there are 10 in total — will drive up the use of hazardous pesticides, destroy neighboring crops and create unnecessary health risks to farmers and rural communities. Will you help ensure USDA knows what's at stake?

Stop the pipeline of new GE seeds!

Dow’s application for 2,4-D-resistant corn is first in the queue, and 2,4-D soy and Monsanto’s dicamba soy are not far behind. With a decision on the first application due any day, we need to speak up now. And loudly.

Scientists warn that 2,4-D corn alone would increase the herbicide's use by 30-fold. The introduction of dicamba soy could cause a similarly dramatic surge in use. And both herbicides are known to drift, easily destroying other farmers’ crops of tomatoes, grapes, beans, cotton, soy — just about any broadleaf plant.

Just as Monsanto's RoundUp Ready seed line led to the emergence of herbicide-resistant "superweeds" across the country, so too will the next generation of GE seeds. And instead of abandoning the losing strategy of stacking seeds with herbicide-resistant traits, Dow, Monsanto and the rest of the Big 6 are introducing more of the same — but with seeds engineered to withstand repeated applications of antiquated, more dangerous chemicals.

Yesterday, Food Democracy Now! received an urgent call from a concerned Congressional staffer about Monsanto's latest efforts to undermine our basic democratic rights.

As politicians in Washington DC discuss the "fiscal cliff", biotech lobbyists are desperate to slide provisions into any end of the year omnibus spending bill to make sure their new GMO crops can evade any serious scientific or regulatory review.

According to sources in DC, Monsanto has once again succeeded in slipping provisions into the House Agricultural Appropriations Bill that have now been added to an omnibus spending bill that certain members of the House of Representatives are desperate to get passed before the end of the year.

The Monsanto Protection Act could pass as early as next week and we need your help today. Click here to stop the Monsanto Protection Act and tell your member of Congress to stand up for your rights and the Constitution!

Food Democracy Now | Stop the Monsanto Protection Act!

These riders, which we dubbed the "Monsanto Protection Act" earlier this year, would strip federal courts of their authority to halt the sale and planting of an illegal and potentially hazardous GMO crop.

As they did earlier this summer, these new provisions, called “riders”, would allow biotech companies to continue to sell their unapproved seeds to farmers, who could plant them while important legal appeals are taking place, instead of halting the planting of the unapproved crop until the court settled the appeal as has been done up until now.

In classic form, the biotech industry has cleverly hidden their toxic plan under the deceptive title of a “Farmer Assurance Provision” (Sec. 733). In truth, the “Monsanto Protection Act” would allow the biotech industry to continue to flout American legal precedence and violate the constitutional separation of powers set forth by our Founding Fathers.

In short, the “Farmer Assurance Provision” is the greatest threat to farmers’ and citizens’ rights that Monsanto and the biotech industry has ever devised and it must be stopped - today!

According to legal experts, this provision “would create a precedent-setting limitation on judicial review” and is a “dangerous assault on fundamental federal and judicial safeguards”.

This current rider is a response to the successful lawsuits that farmers have filed to prevent the sale, distribution and cultivation of GMO sugarbeets and GMO alfalfa, both of which were forced to stop from being planted while the USDA finalized full environment reviews. But once again, Monsanto and the biotech industry are working behind the scenes to shred vital legal rights simply so they can make endless profits.

If allowed to pass, the Monsanto Protection Act would:

Violate the constitutional precedent of separation of powers by interfering with the process of judicial review.
Eliminate federal agency oversight to protect farmers, consumers and the environment from potential harms caused by unapproved biotech crops.

No matter what you believe about GMOs, the fact is that corporations should not have the right to fundamentally undermine our basic rights and constitutional freedoms in their relentless pursuit of profits. Even the consideration of this dangerous provision is a sign of just how much power Monsanto has over our federal government and how far the biotech industry will go to force its genetically engineered food on to the American public.

If allowed to pass, the Monsanto Protection Act will only open farmers and the agricultural economy to very real and significant harm from cross-contamination events. Currently, the Plant Protection Act requires the USDA to regulate GMO crops to protect “the agriculture, environment and economy of the United States”. As a result of previous lawsuits, the USDA is required to complete court-mandated environmental impact statements (EIS) prior to the sale and planting of GMO crops, but even the USDA has shown little regard for this law.

Now, the new provision set forth in the FY 2013 House Agricultural Appropriations Bill and added to a new omnibus spending bill will allow biotech seed and chemical companies to openly skirt even minimal protections of human health and environmental concerns.

Fortunately, Congressman Peter DeFazio (OR-D) is working to circulate a Dear Colleague letter to fellow Representatives in an effort to strike the “farmer assurance provision” currently included in the Agriculture Appropriations Bill and we need your help to make sure your member of Congress signs this important letter to stop the Monsanto Protection Act.

Once again, Monsanto and the biotech industry are working behind closed doors to undermine your basic rights. This time they’ve gone too far! As leaders in Washington DC discuss the "fiscal cliff", biotech lobbyists are desperate to slide provisions in any end of the year omnibus spending bill to make sure their new GMO crops can evade any serious scientific or regulatory review.

In the past, legal advocates have successfully won in court the right to halt the sale and planting of unapproved GMO crops while the approval of those crops is under review by a federal judge. This dangerous new House provision, which we're calling the Monsanto Protection Act, section 733 in the Fiscal Year 2013 Agricultural Appropriations bill has now been included in the end of the year omnibus spending bill in an effort to strip judges of their constitutional mandate to protect consumer rights and the environment, while opening up the floodgates for the planting of new untested genetically engineered crops, endangering farmers, consumers and the environment.

Right now members of Congress are writing a letter to tell members of the Appropriations committee to drop this dangerous provision from any new spending bill. In the next 24 hours your Congressperson needs to hear from you immediately so you can protect your basic democratic rights and the safety of the food that we're eating.
