With the defeat of California Prop 37, the fight to require labeling of genetically modified foods has passed on to other states, such as Washington and Vermont. Although California’s initiative failed on election day, the campaign brought national attention to the issue of labeling GM foods, with 30 other states now working to require GMO labels.

On this episode of Breaking the Set, Abby Martin talks to Jon Rappoport from No More Fake News about Prop 37 voter fraud and how three million votes remain uncounted in California. She then calls out trolls for the first time from Breaking the Set social networks. Dear California MoveOn member,

According to investigative journalist Jon Rappoport, more than one million votes on Prop 37 (the GMO labeling initiative) in California have gone uncounted to date. Since the margin of "victory" is about 600,000 votes, this means Prop 37 may conceivably have passed.

Rappoport called the voter registrar offices in the largest California counties and nearly 1.7 million votes remain uncounted in Santa Clara, Los Angeles, San Diego, and Orange Counties alone. It is still unknown how many votes are uncounted in other California counties.

We demand that the results of this complete ballot counting be made public immediately.

When I read the news that Prop 37 had been defeated, I was shocked and saddened as I knew a great campaign had been run to defeat Monsanto and its flock of agri-business friends and their infinitely deep pockets that had funded the “No Campaign.” I knew that the “No Campaign” had been unscrupulous and had resorted to fraudulent tactics and misleading advertising just so Californians would not be able to have label transparency so that they would know what they were consuming. With the many grassroots organizations (including the National Health Federation) and many thousands of consumers fighting a clean, strong battle, we couldn’t match the funds but the vote call of defeat was so close.

Don’t hang up your hats quite yet, read further, this battle isn’t over!

Jon Rappoport, of No More Fake News Jon Rappoport Investigative Reporter had alerted readers to the fact the “No Campaign” had feloniously used the official FDA seal and statements during their campaign attributing the statements to the FDA, WHO, and other organizations to convince Californians to vote against Prop 37. Rappoport stated, “The NO ON 37 forces have been caught in a deception. They used the official seal of the FDA in a mailer, and above that seal they attributed a quote to the FDA which was never made by that agency. The quote was: "The US Food and Drug Administration says a labeling policy like Prop 37 would be 'inherently misleading.'"

On November 8th, I read Jon’s next article concerning Prop 37, fraud, and the final vote counting issue. I immediately contacted Jon and Barbara Peterson of Farm Wars ( Farm Wars), both strong health-freedom fighters, and they and NHF decided to fight back. Was Proposition 37 really lost? Why was the “Yes Campaign” stating defeat we wondered. The final vote count wasn’t until December 14th, there had been obvious fraud by the opposing campaign, and our collective nature is to fight until the end. NHF contacted some of the main “Vote Yes” groups questioning their calling defeat, Jon continued investigating those who actually had called the vote and other issues while Barbara sent word out to her lists and decided to get our questioning message out on an upcoming George Noory radio show. The ball was rolling and is still rolling. People and organizations are getting back up to continue the fight for Prop 37 now and the NHF asks that all readers join us by informing others.

The issues at hand now are below and this is information to get out to people that this issue isn't over until all votes are counted and the fraud issue pursued.

Over 3 Million Votes Remain Uncounted Election Results:


These results are from the California Secretary of State as of
November 8, 2012 at 4:30 a.m. PST with 100% of the state's
24,491 precincts partially reporting. The vote total will grow
substantially as each precinct counts its absentee, mail-in and
provisional ballots. This results section will be updated daily
until the final results have been certified in about three weeks.

Thank you so much for signing this petition.

I have to admit I have learned a great deal since starting it.

ALL VOTES ON PROP 37 WILL BE COUNTED, not because of our petition, but because it is required by law that all votes be counted. The counties have until December 7 to report the vote and Debra Bowen, Secretary of State, has until December 14 to certify the vote.

The final results WILL BE PUBLISHED, so every vote cast on Prop 37 will be honored.

Because of the importance of this issue nationally, I am researching how to have an effective petition at a national level.

Thank you, once again, for taking a stand on this important issue.

We have a right to know how the food we buy is produced. Yet the FDA's current policy does not provide us with the ability to make informed choices about genetically engineered foods because they are not labeled.

Over forty countries – including Russia and China – require the labeling of genetically engineered foods. We have the power to fix this here in the United States, and there's never been a more pressing time.

The FDA is on the brink of approving genetically engineered salmon, which would be the first genetically engineered animal on supermarket shelves in the United States. The salmon is engineered to produce growth hormones year-round that cause the fish to grow at twice the normal rate. The government already requires labels to tell us if fish is wild-caught or farm-raised – don't we also have a right to know if our salmon is genetically engineered? But without labels, we'll never know.

You stood with more than one million Americans for our right to know by contacting the FDA demanding that genetically engineered foods be labeled. But there are so many others who haven't heard anything about the reasons to label genetically engineered foods.

Last week more than 5 million California voters stood up for transparency and labels on genetically engineered foods by voting Yes on Prop 37. We came up short on election night, but have built a powerful movement that has changed the conversation on GMO labeling in the U.S. forever.

At Food Democracy Now! we want to express our gratitude for you and all of our members who helped place Prop 37 and labeling of genetically engineered foods as a central part of the national debate during this year’s election.

It was a hard fought race and we’ve been amazed and inspired by the grassroots support in California and across the country. Despite being outspent nearly 6 to 1, the Yes on 37 campaign fought Monsanto and DuPont to a standstill with 47.6% to 52.4% at the polls.

We may not have won on election night, but what we did gain is unprecedented and can never be taken from us: the fact that millions of people have stood up for democracy and labeling of genetically engineered foods, and we have fundamentally changed the conversation in the U.S. forever.

What's next?

Along with our allies, we've been encouraged to hear this question ring throughout California among those who gave their heart and soul to this fight and within the growing national food movement: "What's next?"

Food Democracy Now! has been a part of this fight from the beginning and along with our close allies who fought with us every step of the way, we can tell you that this fight is not over and we will not stop until we achieve transparency and the basic Right to Know what's in our food.

Why do 61 other countries enjoy this right while Americans do not?

Election Results and False Reports of Voter Fraud

Despite numerous reports of voter fraud in the election on Yes on 37, there have been no proof of fraud or vote tampering in California. As with every election, not every ballot is counted on election night and currently Food Democracy Now! is working with the California Right to Know campaign to monitor the final vote tally from the state.

As of November 16, 2012, the vote totals are 5,869,382 NO to 5,329,994 YES, with the NO side ahead 52.4% to 47.6%.

California state law requires county elections officials to report their final results to the Secretary of State by December 7. The Secretary of State has until December 14 to certify the results of the election.

Food Democracy Now! will continue to monitor these election results with our allies and report the latest results.
